1. Acceptance of these terms
By downloading or using the Palmas mobile app or this website (together, the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service.
2. The service
Palmas recommends things to do in Las Palmas de Gran Canaria — swimming, surfing, hiking, stargazing, and more — based on forecast weather, sea, and sky conditions, along with local events. We may add, change, or remove features at any time as the app evolves.
3. Your account
You do not need an account to use Palmas — recommendations work without signing in. You can optionally sign in with Google or Apple. If you do, you're responsible for keeping access to that account secure and for activity that happens under it. You must be at least 14 years old to create an account.
4. Acceptable use
You agree not to misuse the Service. In particular, you will not:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to our systems or other users' accounts
- Interfere with or disrupt the operation of the Service
5. Price
Palmas is free. There are currently no purchases, subscriptions, or advertisements in the app. If we ever introduce a paid tier, we'll update these terms and the app will show prices clearly before you pay anything.
6. Intellectual property
The Service, including its design, code, and branding, belongs to Kealy Studio and is protected by applicable intellectual property laws. These terms don't grant you any rights to our trademarks or branding.
7. Forecasts, conditions, and your safety
Palmas's recommendations are based on forecasts, and forecasts are sometimes wrong. Sea, weather, and air conditions can change quickly and can differ from what the app shows. The Service is not a safety service: always check actual conditions where you are, obey beach flags, lifeguards, and official warnings, and use your own judgement — especially in the ocean and the mountains. You are responsible for your own safety decisions.
Beyond that, the Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or fit for any particular purpose.
8. Limitation of liability
To the maximum extent permitted by law, Kealy Studio will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including decisions you make based on its recommendations. Nothing in these terms limits liability that cannot be limited under applicable law.
9. Termination
You can stop using the Service at any time, and delete your account in the app or via the data deletion page. We may suspend or terminate your access if you breach these terms, with notice where reasonably possible.
10. Governing law
These terms are governed by the laws of Spain, and any disputes will be resolved in the Spanish courts. If you use the Service as a consumer in another country, this doesn't affect any rights or protections you have under the laws of the country where you live.
11. Changes to these terms
We may update these terms from time to time. When we do, we'll update the date at the top of this page and, for significant changes, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated terms.
